Mark Himelstein, Of Counsel

Mark HimelsteinMark Himelstein, Of Counsel, has been practicing law in the Bay Area since 1969, trying cases in state and federal courts and handling numerous appeals in the appellate systems.  His areas of expertise cover a wide range of civil issues, including tort and contract claims, constitutional torts, commercial disputes, real property law, landlord/tenant disputes, and probate and trust matters.  Mark's civil practice area covers both transactions and litigation, representation of private, educational institutions, non-profit organizations, business entities and individuals as well as insurance defense.

Mark's appellate practice includes numerous appearances before the State Courts of Appeal, the United States Court of Appeal for the Ninth Circuit and the California Supreme Court.  Published decisions include:

o Smith v. Regents, 56 Cal. 4th 979 (1997);
o Smith v. Regents, 4 Cal. 4th 843, 844 P.2d 500 (1993);
o Mann v. Alameda County, 85 Cal.App 3d 505 (1978);
o Zumwalt v. Trustees, 33 Cal.App. 3d 665 (1973);
o Mabey v. Reagan, 537 F 2d. 1036 (1976), 376 F.Supp. 216 (1974);
o Toney v. Reagan, 326 F.Supp. 1093, 467 F 2d. 953, cert.   denied 409 US 1130(1972);
o People v. Colbert, 24 Cal.App. 3d 497 (1972); and
o Buchwald v. Katz, 8 Cal. 3d 493 (1972).

Mark received an undergraduate degree from Indiana University in 1962; served in the Peace Corps in Ethiopia in 1962-1964; and, received a LLB from the George Washington University School of Law in 1967.  He first worked for the Office of the General Counsel of the Federal Home Loan Board in Washington, D.C., now Office of Thrift Supervisions, then for California Rural Legal Assistance in California.  In 1969 he formed his own firm in San Francisco, initially Penrod and Himelstein, thereafter Penrod, Himelstein, Savinar & Sims, thereafter Himelstein & Savinar.  In 1998, he became Of Counsel to Jon York and Associates.
